1. Acceptance of Terms
Welcome to StreamGlean, a service operated by KoKi Studios LLC ("Company," "we," "us," or "our"). By accessing or using StreamGlean (the "Service"), including our website at streamglean.com and any associated applications, you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you may not access or use the Service. We may update these Terms from time to time. We will notify you of material changes by email or by posting a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of the Service after such notice period constitutes acceptance of any changes.
2. Eligibility
You must be at least 18 years old to create an account and use StreamGlean. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features of StreamGlean, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
By creating an account, you consent to receive service-related electronic communications from us, including billing notifications, security alerts, and product updates. You may opt out of non-essential communications at any time through your account settings.
4. Description of Service
StreamGlean is a livestream analytics and memory platform that helps content creators understand their streams. The Service captures chat data, engagement metrics, audio and video content (via optional integrations such as the OBS plugin), and other stream-related information to provide insights, highlight detection, and searchable archives. The Service uses automated processing technologies, including artificial intelligence, to analyze stream content and generate insights.
The insights, summaries, and analysis generated by the Service are produced using automated technologies and are provided for informational purposes only. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying any insights before relying on them.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the StreamGlean OBS plugin and any other client-side software we provide solely in connection with your authorized use of the Service. This license terminates automatically when your account is terminated or your subscription expires.
5. Subscriptions and Payments
StreamGlean offers a paid subscription service. By subscribing, you agree to pay all applicable fees. Payments are processed through Polar, our Merchant of Record. All fees are non-refundable except as expressly set forth in our Refund Policy. Refund Policy.
Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings or the Polar customer portal.
6. Free Trial
We may offer a free trial period for new subscribers. During the trial, you will have access to the full Service. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.
7. User Conduct
You agree not to use StreamGlean to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Transmit any malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use the Service to harass, abuse, or harm others
- Interfere with or disrupt the Service's operation
8. Creator Responsibilities
By using StreamGlean to capture and analyze your livestreams, you acknowledge that the Service collects and processes publicly available chat messages, usernames, and participation data from your stream viewers. These viewers may not be StreamGlean users and may not have a direct relationship with us.
You are responsible for ensuring that your use of StreamGlean complies with the terms of service of the streaming platforms you use and any applicable laws in your jurisdiction. You agree not to use the Service to process data from private or restricted streams without appropriate consent or authorization from participants.
If you enable the StreamGlean Discord bot in your Discord server, you acknowledge that the bot may collect and process messages and interaction data from members of that server. You are responsible for informing your server members that the bot is active and may process their messages.
9. Intellectual Property
StreamGlean and its original content, features, and functionality are owned by KoKi Studios LLC and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit through the Service, but grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, reproduce, and process such content solely to provide and improve the Service. This license includes the right to share your content with third-party service providers acting on our behalf.
We may use aggregated, anonymized data derived from your use of the Service for analytics, product improvement, and research purposes. Such data will not identify you or any individual stream viewer.
10. Third-Party Services
StreamGlean integrates with third-party streaming platforms (Twitch, YouTube, Kick) and payment processors. Your use of these integrations is subject to the respective third parties' terms of service. We are not responsible for the content, privacy practices, or availability of third-party services.
By connecting your YouTube account, your use of StreamGlean is also subject to the YouTube Terms of Service and Google's Privacy Policy. StreamGlean's use of data received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You may revoke StreamGlean's access to your platform accounts at any time through your account settings or directly through the respective platform's settings.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOKI STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless KoKi Studios LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
Upon termination of your account, you may request an export of your data within 30 days by contacting us at customer-support@kokistudios.com. After this period, we will delete or anonymize your data in accordance with our Privacy Policy.
15. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, or third-party platform outages.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Oregon.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and KoKi Studios LLC regarding your use of the Service and supersede any prior agreements or understandings.
